Illinois has adopted new guidelines for Spousal Support (also called maintenance and formerly called alimony) for families whose combined Income is less than $250k. The new law becomes effective on January 1, 2015.
No one wants to go thru the tragedy of a divorce. But staying together can be even worse, particularly for the children. The bickering and arguments are disruptive on everyone’s life, particularly on the children. Unwinding the relationship and providing for the future dealings is difficult, but using the services of one of our caring and sensitive Chicago divorce lawyers in the process could make it easier and less expensive.
Prenups Solve Lots of ProblemsThe best thing to help get through the difficulties of a divorce is take the recommendations we give our business clients -- have an agreement signed before getting married will solve a lot of anguish. A well drafted Prenuptial Agreement is legally enforceable. It is like any other business contract. But it takes an experienced lawyer to help gather up all of the information and insure that all of the details needed are included to make it enforceable.
Prenups could cover many issues. Prenups can provide for spousal support (alimony) – even limiting or waiving support. Prenups should provide for the division of property – who gets what and how. Prenups cannot control issues regarding the children such as custody or the amount of support. Those terms must be approved by the court.
But prenups can be attacked if not properly drafted. A judge can throw it out if all of the formalities are not carefully followed. That is why we strongly urge people to seek qualified and experienced counsel in preparing a prenup.
When divorce looms as the only option, then people should seek the counsel of lawyers who are experienced and sensitive to the needs of the family as a whole, and in particular that means the children. The Chicago divorce lawyers of Bellas & Wachowski Attorneys at Law are caring and sensitive to the plights of divorcing parents and their children.
